Important DER role note: Under 49 CFR Part 40, the Designated Employer Representative must be an employee of the employer who is authorized to take immediate action to remove a driver from safety-sensitive duties. A C/TPA or other service agent may assist with program administration but may not act as the employer’s DER.

Course Description

This course is designed for individuals serving as a Designated Employer Representative (DER)
under 49 CFR Part 40.

The training explains the DER’s role in administering the DOT drug and alcohol testing program,
including receiving verified test results, taking required regulatory actions, managing refusals
and violations, coordinating with Medical Review Officers and Substance Abuse Professionals,
ensuring Clearinghouse compliance, and maintaining required records.

This course is limited to DOT drug and alcohol program administration and does not cover general
FMCSA compliance topics such as hours of service, vehicle maintenance, or CDL licensing.

Important:
This training does not authorize DERs to make medical determinations, interpret test results,
or perform testing functions.
