Drug and alcohol compliance is a critical part of maintaining safety in the transportation industry and protecting both drivers and the public.
Do I need a DOT drug and alcohol testing program?
If you operate a CDL-required CMV under your own authority: Yes. You must participate in a DOT drug and alcohol testing program (49 CFR Part 382), join a random testing pool — most owner-operators contract with a Consortium/Third Party Administrator (C/TPA) — and meet Clearinghouse query and reporting obligations. If you are leased to a motor carrier: Your testing obligation typically rolls up to the carrier’s program. Confirm in writing with the carrier which party is responsible. If you employ other CDL drivers: You also need to meet employer-side obligations including DER designation and (where applicable) supervisor reasonable-suspicion training. What This Course Does Not Cover
This course does not register you in a testing program — you must contract with a C/TPA separately
This course does not perform Clearinghouse queries or report violations — those are separate actions you take in the FMCSA Clearinghouse
This course is not a substitute for the supervisor reasonable-suspicion training under §382.603 if you supervise CDL drivers
This course does not cover the same content as the CDL Driver Drug & Alcohol Policy Training (which is the driver-education side of §382.601)
Frequently Asked Questions.
Do I need a testing program if I’m a one-person owner-operator?
Yes if you operate a CDL-required CMV under your own authority. FMCSA does not exempt one-person operations.
Do I need to join a C/TPA?
For random testing, virtually all owner-operators participate via a consortium because §382.305 requires being in a pool of at least 50 covered drivers (or smaller pools meeting specific criteria). A C/TPA aggregates owner-operators into a qualifying pool.
What about the Clearinghouse?
Owner-operators have full Clearinghouse responsibilities. You must register, designate a C/TPA in the Clearinghouse, and perform queries and reporting on yourself just as a carrier would on its drivers.
Does this course replace my carrier’s policy if I’m leased?
No. If you’re leased to a carrier, the carrier’s written policy and program govern.
Marijuana is legal in my state — am I covered?
No. Marijuana use is prohibited for all CDL drivers in DOT-regulated operations regardless of state law (49 CFR Part 40).
